SEEME SERVICE TERMS OF USE
1. The right to use the SEEME service shall be granted
to the person (hereinafter USER) who has entered into a contract for the
provision of the SEEME service (hereinafter CONTRACT) with Oskando Ltd (hereinafter
OSKANDO) or an official distributor of the SEEME service (hereinafter both
referred to as SEEME SERVICE DISTRIBUTOR).
2. In addition to the definition given to USER in
clause 1, within the current terms of use USER shall also be regarded as the
natural person who enters the website of the SEEME service using the user name
and password granted to the USER (hereinafter USER DATA).
3. THE USER is obliged to follow all the terms of use specified
herein as well as any other terms specified in the CONTRACT.
4. USER shall be able to use the SEEME data processing service via the web
interface of the SEEME service at the address specified by the SEEME SERVICE
DISTRIBUTOR. The essence of the SEEME data
processing service is the following: via the web interface of the SEEME service
the USER is provided various types of information (depending on the level of
service as specified in the CONTRACT) about the location and routes of the
USER’s vehicle(s) compiled on the basis of the location data sent to the
OSKANDO server by the GPS/GPRS tracker (hereinafter TRACKER) registered for the
use of the SEEME service.
5. The SEEME
service can be used only with such TRACKERS that have been listed in the CONTRACT
and that have been registered for use with the SEEME service.
6. SEEME
SERVICE DISTRIBUTOR shall have the right to make changes to the USER DATA if it
is necessary for ensuring the security of the SEEME service. Upon changing the
USER DATA, SEEME SERVICE DISTRIBUTOR shall provide the USER with new USER DATA
and the access to the SEEME web interface with the outdated USER DATA shall be
blocked.
7. The USER
is obliged to keep the USER DATA confidential and ensure that the USER DATA are
used solely by the persons authorized to do so by the USER. SEEME SERVICE
PROVIDER shall not be liable for any damages caused by the use of the USER DATA
by unauthorized persons. SEEME SERVICE PROVIDER shall not disclose the USER
DATA to third parties, except for the contractual partners used for the
provision of the SEEME service or in case the disclosure of such data is
required by a legal act or the decision of a state body, local government body or
the court.
8. Within
the framework of the SEEME service, SEEME SERVICE DISTRIBUTOR shall not be held
responsible for any circumstances due to which the source data required for
displaying the results of the data processing operation do not reach the server
used by OSKANDO in the provision of the services (for instance, when the signal
of the GPS and/or the GPRS is low or if communication services encounter any other
error).
9. OSKANDO shall
have the right to update the information technology solutions of the SEEME service
and further specify the source data of location information at any time. In the
occurrence of such updates and amendments OSKANDO shall not be obliged to ask
for the advance approval of THE USER. SEEME SERVICE DISTRIBUTOR shall inform
THE USERS of the most relevant changes on the website of the SEEME service or
via e-mail.
10. OSKANDO
shall have the right to perform maintenance of the SEEME service, install
updates and block access to the service while such operations are performed.
11. The
right to use the SEEME service shall not grant the USER any rights to the
intellectual property that is related to the service or that is the basis of
the service. The USER is not permitted to copy, distribute, alter or in any
other way use the materials of the web interface of the SEEME service or the
parts thereof, except the data displayed during the provision of the service,
which the USER intends to use in its business or professional operations.
12. In order
to enable OSKANDO to process the location data and other source data necessary
for the provision of the SEEME service, the USER shall give OSKANDO the right
to use such data in the provision of the service in the volume and scope deemed
necessary. OSKANDO shall preserve the data for 1 (one) year, except the data
deleted by the USER via the web interface of the SEEME service.
13. The USER
shall be responsible for complying with applicable personal data protection
regulations, including, but not limited to, obtaining required permissions from
natural persons subjected to data processing, and applying security, administrative,
and other measures of personal data and privacy protection. SEEME SERVICE
DISTRIBUTOR can not be held responsible for actual or alleged breaches of
personal data protection and/or privacy rights.
14. The USER
is not permitted to use the SEEME service in illegal operations or in a manner
that inhibits other USERS from using the service or damages the property of
others.
15. OSKANDO shall
have the right to make changes to the terms of use specified herein. Upon
changing of the terms of use, the USER shall be informed of the new terms of
use on the website of the SEEME service.
16. In case the
USER fails to meet the requirements specified in clause 3 of the terms of use
listed herein, SEEME SERVICE DISTRIBUTOR shall have the right to suspend and/or
terminate the CONTRACT for the provision of the SEEME service pursuant to the
procedure provided by the CONTRACT. Additionally, under such circumstances SEEME
SERVICE DISTRIBUTOR shall not guarantee the proper functioning of the SEEME service
or be held responsible for any consequences resulting from the improper
functioning and/or interruption of the service.
